Terms of Service

1. Acceptance of Terms
By accessing or using Ditto ("the Service"), operated by iAppLabs ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification at least 14 days before they take effect.
2. Service Description
Ditto is a SaaS platform that provides tools for collecting, organizing, and acting on user feedback. The Service includes:
- Feedback Boards — Create categorized boards where users can submit feature requests, bug reports, and suggestions.
- Voting System — Enable users to upvote and prioritize feedback items.
- Public Roadmap — Share your product roadmap transparently with your user base.
- Changelog — Publish release notes and product updates to keep users informed.
- Embeddable Widget — A lightweight JavaScript widget that can be embedded in any website or application to collect feedback inline.
- REST API — Programmatic access to feedback, boards, posts, votes, and changelog data for custom integrations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration & Responsibilities
To access certain features of the Service, you must create an account by providing accurate, complete, and current information. You are solely responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account, whether authorized or not.
- Promptly notifying us of any unauthorized use of your account.
- Ensuring that your account information remains accurate and up to date.
You must be at least 16 years old (or the minimum age required in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.
4. User Content & Intellectual Property Rights
You retain full ownership of all content you submit to the Service, including feedback, comments, votes, and any other materials ("User Content"). By submitting User Content, you grant iAppLabs a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the Service.
The Service itself, including its design, code, branding, and documentation, is the intellectual property of iAppLabs and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.
5. Acceptable Use Policy
You agree not to use the Service to:
- Submit or distribute content that is unlawful, defamatory, harassing, abusive, fraudulent, or obscene.
- Impersonate any person or entity, or falsely claim affiliation with any person or entity.
- Transmit viruses, malware, or any code of a destructive nature.
- Attempt to gain unauthorized access to any part of the Service, other user accounts, or related systems.
- Use automated means (bots, scrapers) to access the Service except through our published API.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any activity that violates applicable local, state, national, or international law.
Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account without prior notice.
6. API & Widget Usage
Access to the Ditto API and embeddable widget is subject to the following conditions:
- Rate Limits: Public and authenticated endpoints are protected by rate limiting. Exact thresholds may change as we tune abuse protection and plan capacity.
- Authentication: All API requests must include a valid API key. You are responsible for keeping your API keys secure and must not share them publicly.
- Attribution: If you use the free plan, the embedded widget must retain the "Powered by Ditto" attribution link. Paid plans may remove this attribution.
- Fair Use: The API and widget must not be used to build a competing product or to resell access to the Service.
7. Payments & Subscriptions
Ditto offers the following subscription plans:
- FREE — 1 board, up to 100 posts, 1 API key, 10 changelog entries, and community support. No credit card required.
- PRO — 3 boards, unlimited posts, 5 API keys, unlimited changelog, embeddable widget access, branding removal, Slack notifications, and email support.
- TEAM — Higher published usage limits plus exports, webhooks, and workspace features available in the product at the time of purchase. Enterprise-only requirements may require written confirmation from us before purchase.
Payments are processed securely through Stripe. Subscriptions are billed monthly or annually in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. We reserve the right to change pricing with 30 days' notice. If a payment fails, we will attempt to charge the payment method up to 3 times before suspending service.
8. Termination
You may terminate your account at any time by deleting it from your account settings. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason including:
- Breach of these Terms or the Acceptable Use Policy.
- Non-payment of subscription fees after the grace period.
- Inactivity exceeding 12 months on a free plan.
- A request by law enforcement or government authority.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion, during which you may request a data export. After 30 days, all data is permanently deleted.
9. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IAPPLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless iAppLabs, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your User Content, or your violation of these Terms.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Brazil. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of São Paulo, Brazil. Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
